Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TRIPLE A SOLUTIONS S.R.L. (IDNO: 1026605000406), a company registered in the Republic of Moldova with its registered office at s. Ciuciuleni, rn. Hîncești ("Company," "we," "us," or "our"), governing your access to and use of the HookBandit website, application, and services available at hookbandit.com (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

HookBandit is a software-as-a-service (SaaS) tool designed for social media managers and content creators. The Service allows you to input Instagram profile usernames or individual post URLs and receive AI-generated content analysis reports. These reports include hook analysis, caption analysis, content type breakdowns, posting patterns, and actionable insights based on publicly available Instagram content.

The Service is offered on a freemium basis. Certain features are available at no cost, while premium features require a paid subscription. Specific feature availability and limitations for each tier are described on our pricing page and may change from time to time.

We reserve the right to impose fair-use limits (such as daily or monthly quotas on reports or analyses) to keep the Service fair and available for all users. Current limits are communicated through the application interface.

You must be at least 16 years of age to use the Service. By using HookBandit, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

The Service is available globally. However, you are solely responsible for ensuring that your use of the Service complies with all laws and regulations applicable in your jurisdiction.

To use the Service, you must create an account using Google OAuth or another authentication method we provide. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must promptly notify us at contact@hookbandit.com if you become aware of any unauthorized access to or use of your account.

We are not liable for any loss or damage arising from your failure to maintain the security of your account.

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following content and behaviors are strictly prohibited:

Enforcement. We reserve the right to investigate violations, suspend or terminate your account, block IP addresses, and take legal action as appropriate.

"Your Content" refers to any data you submit to the Service, including Instagram profile usernames, post URLs, brand descriptions, and any other information you provide.

You retain all ownership rights in Your Content. By submitting Your Content, you grant us a limited, non-exclusive, non-transferable, revocable license to process Your Content solely to provide the Service — that is, to scrape publicly available data from the submitted profiles or posts, analyze it, and generate reports.

Data handling. Raw scraped data from Instagram profiles is automatically deleted after processing. Only the final analysis results and report outputs are stored in your account for your continued access. The Instagram profile usernames and post URLs you submit are stored as part of your account configuration.

No AI training. We do not use Your Content to train, fine-tune, or improve any artificial intelligence or machine learning models. Your data is used exclusively to deliver the Service to you.

You represent and warrant that you have the right to submit Your Content and that doing so does not violate any third-party rights or applicable law.

"Generated Output" refers to the reports, analyses, insights, and any other content produced by the Service based on Your Content.

Ownership. You own the Generated Output and may use it for any lawful purpose, including commercial use.

Your responsibility. Because Generated Output is produced using artificial intelligence, you are solely responsible for:

• Verifying the accuracy, completeness, and appropriateness of all output before relying on it or publishing it
• Ensuring that the output does not infringe third-party trademarks, copyrights, or other intellectual property rights
• Complying with the terms of service of any platform (including Instagram) whose content was analyzed

Copyright note. AI-generated content may not qualify for copyright protection in all jurisdictions. You should consult with a qualified legal professional if copyright ownership of Generated Output is important to your use case.

The Service relies on the following third-party providers. Your use of the Service is also subject to these providers' respective terms and policies:

• Google Gemini (AI analysis) — Terms of Service
• Apify (data collection) — Terms of Use
• MAIB (payment processing) — Terms and Conditions
• Supabase (infrastructure & authentication) — Terms of Service

We are not responsible for the practices, policies, or availability of any third-party services. Data you submit for analysis may be processed by these providers in accordance with their own terms and privacy policies.

HookBandit offers both free and paid subscription plans. The features, limits, and pricing of each plan are described on our pricing page and within the application.

The Service, including but not limited to its name, logo, website design, user interface, source code, algorithms, templates, documentation, and all related intellectual property, is owned by TRIPLE A SOLUTIONS S.R.L. and is protected by applicable intellectual property laws.

Nothing in these Terms grants you any right to use our trade names, trademarks, service marks, logos, domain names, or other distinctive brand features without our prior written consent.

For the avoidance of doubt, Your Content (as defined in Section 6) and Generated Output (as defined in Section 7) remain your property, as described in the respective sections above.

By you. You may terminate your account at any time by deleting it through your account settings. Upon account deletion, all your data — including reports, tracked profiles, favorites, and account information — will be immediately and permanently deleted. This action is irreversible and data cannot be recovered.

By us. We may suspend or terminate your account and access to the Service at any time, with or without cause, if we reasonably believe that you have violated these Terms, engaged in prohibited conduct under Section 5, or if continued provision of the Service to you is no longer commercially viable.

Effect of termination. Upon termination, your right to use the Service ceases immediately. Termination does not affect any provisions that by their nature should survive, including but not limited to Sections 6 (Your Content), 7 (Generated Output), 8 (AI Disclaimer), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 15 (Indemnity), and 16 (Governing Law & Venue).

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. HOOKBANDIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, APPROPRIATE, OR FREE OF INFRINGING CONTENT. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

To the maximum extent permitted by applicable law, TRIPLE A SOLUTIONS S.R.L. and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, reputation, business opportunities, or goodwill, arising from or in connection with your use of or inability to use the Service.

In no event shall our total aggregate liability to you for all claims arising from or relating to these Terms or the Service exceed one hundred United States dollars (USD $100.00).

Jurisdictional carve-out. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, the Company's liability is limited to the maximum extent permitted by law, and the above limitations or exclusions may not apply to you.

You agree to indemnify, defend, and hold harmless TRIPLE A SOLUTIONS S.R.L. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or in connection with:

• Your Content submitted to the Service
• Your use of Generated Output
• Your violation of these Terms
• Your violation of any third-party rights or applicable law
• Any claim that your use of the Service caused damage to a third party

These Terms shall be governed by and construed in accordance with the laws of the Republic of Moldova, without regard to its conflict-of-law principles.

Any disputes arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of Moldova.

We reserve the right to update or modify these Terms at any time. When we make changes, we will revise the "Last updated" date at the top of this page. For material changes, we may also provide additional notice through the application interface or via email.

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
